ITS Terms of Use

You Agree to These Terms by Using This Site 

Thanks for touching down on the Information Technology Support (“ITS”) website (referred to here as “ITS,” “the Site,” “us,” or “our”) to explore our galaxy and apply for open crew positions. 

 

These Terms of Use apply to any use of the Site, including our online Job Application Portal (the “Job Portal”) and any other feature, content, or service made available through the Site or through websites or mobile applications under the control of ITS.  

 

The Site and the Job Portal are available to users who are 18 years of age or older. By using the Site or the Job Portal, you represent and warrant that you are at least 18. 

 

The Job Portal allows anyone over 18 to register (as a “Candidate”) in order to apply for job openings advertised on the Site. We are under no obligation to accept anyone as a Candidate, and we may accept or reject any Candidate’s registration at our sole discretion. 

 

When you use the Site or the Job Portal, you’re agreeing to abide by these Terms of Use, including any other agreements referenced within them (such as our “Recruitment Privacy Policy,” located on the Site), so please take a few minutes to review them. If you don’t agree to these Terms of Use, the Privacy Policy, or any other referenced agreements, please abort mission, and do not use the Site or Job Portal. 

Ownership of Site Content  

The Site and all its contents, including but not limited to all text, images, audio, and video (collectively, the “Site Content”) are owned and copyrighted by ITS, its subsidiaries, sponsors, or affiliated companies, or others, with all rights reserved unless otherwise noted. Any Site Content that is a trademark, logo, or service mark is a registered and/or unregistered trademark of ITS or others. Your use of any Site Content, except as provided in these Terms of Use, without prior written permission of the Content owner, is strictly prohibited. ITS will fully enforce its intellectual property rights under the law.  

Registration, Application, and Submissions 

If you encounter a position within the ITS universe that aligns with your interests and qualifications, you can apply via the Job Portal. In registering with us through the Job Portal, you agree to (1) provide accurate, current, and complete information about yourself and (2) maintain and promptly update that information to keep it accurate, current and complete.  

 

You are responsible for all activities that occur under your account, whether performed by you or a third party. If you submit any content through the Job Portal, such as a cover letter, resume, or other documents (referred to as a “Submission”), that is not accurate, current, or complete, or we have reasonable grounds to suspect that it’s not, ITS has the right to suspend or terminate your account and restrict your use of the Site and/or the Job Portal. You agree not to create an account using a false identity or on behalf of someone other than yourself, and not to have more than one account. You also agree not to create an account or use the Site or the Job Portal if you have been previously removed or banned from the Site by ITS.  

Your Use of the Site and Job Portal 

We’re a welcoming and inclusive crew at ITS, and we ask the same of anyone who makes contact with our Site and Job Portal. 

 

When using the Site or the Job Portal, please act reasonably and responsibly with others, stay within the realms of decency, and comply with these Terms of Use and all applicable laws. Your continued access to the Site and Job Portal is contingent on your agreement not to do the following:  

 

• Distribute, modify, copy, transmit, display, reuse, publish, license, create derivative works from, transfer, sell, or otherwise use Site Content without the express and written permission of ITS. 

• Use the Site or Job Portal to post any infringing, threatening, false, misleading, abusive, libelous, obscene, or inflammatory material or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law.  

• Use the Site or Job Portal to impersonate any person or entity, including any representative of ITS or its affiliates, or to falsely state or otherwise misrepresent your affiliation with any person or entity in connection with the Site, or to state or imply that ITS endorses any statement you make. 

• Use the Site or Job Portal to advertise or perform any commercial solicitation.  

• Use the Site or Job Portal to post any computer code, file, or program that is harmful or invasive or could damage the operation of or monitor the use of any ITS hardware, software, or equipment (such as any virus, worm, Trojan Horse, Easter egg, time bomb, adware, spyware, malware, rootkit, keylogger, or ransomware).  

• Use the Site or Job Portal to violate the legal rights of others or to collect personally identifiable information about users. 

• Restrict any other person from using the Site or Job Portal.  

• Interfere with the operation of the Site, the Job Portal, or the servers or networks used to make them available, or violate any requirements, procedures, policies, or regulations of such networks. 

• Modify, adapt, translate, reverse engineer, decompile, or disassemble any portion of the Site or Job Portal.

Privacy, Data Protection, and Account Security 

To access the Job Portal to apply for an open position with the ITS crew, you will be asked to provide certain registration details, including personal data (for example, your name, address, phone number, or email address), to create an account. This personal data will only be used by ITS in accordance with our Recruitment Privacy Policy, as posted and updated on the Site. Any other communication or material that you transmit to the Site, such as questions or comments, will be treated as non-confidential and non-proprietary. Email and other transmissions will not be encrypted or otherwise secured. 

 

Your account is yours alone, and you may not disclose your username, password, or any other piece of information that is part of our security procedures to any other person or entity. Please also use caution when accessing your account from a public or shared computer to ensure that others cannot view or record your personal information. 

 

You agree to notify us immediately of any unauthorized access to or use of your username or password or any other breach of security. You also agree to exit your account at the end of each session (by logging out). We have the right to disable your username, password, or other identifiers at any time if we feel you have violated any of these Terms of Use. 

Limitation on Liability 

ITS is not liable for any damages resulting from your use of the Site or the Job Portal. 

 

YOUR USE OF THE SITE OR JOB PORTAL IS AT YOUR OWN RISK. ITS IS NOT LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR OTHER DAMAGES. THIS INCLUDES DAMAGES ARISING OUT OF OR CONNECTED WITH THE USE OF THIS SITE AND/OR JOB PORTAL, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF ANY SUCH DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, USE, DATA, LOSS OF OTHER INTANGIBLES, LOSS OF SECURITY OF INFORMATION YOU HAVE PROVIDED IN CONNECTION WITH YOUR USE OF THE SITE OR JOB PORTAL, OR UNAUTHORIZED INTERCEPTION OF ANY SUCH INFORMATION BY THIRD PARTIES, EVEN IF ADVISED IN ADVANCE OF SUCH DAMAGES OR LOSSES. IN PARTICULAR, AND WITHOUT LIMITATION, ITS WILL NOT BE LIABLE FOR DAMAGES OF ANY KIND RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SITE OR JOB PORTAL OR RESULTING FROM ANY CONTENT YOU SUBMIT. YOUR SOLE COURSE OF ACTION IF YOU ARE DISSATISFIED WITH THE SITE IS TO STOP USING IT.  

 

Please note that some places in the universe may not allow the exclusion of certain damages, so some of the above exclusions may not apply to you. 

Links to Third-Party Sites 

If the Site or Job Portal contains links to other sites and resources outside of our orbit, which are owned or operated by parties other than ITS (“Third-Party Sites”), these are provided for your convenience only. We have no control over the contents of such Third-Party Sites or resources, and we accept no responsibility for them or for any loss or damage that may arise from your use of them. If you decide to access any of the Third-Party Sites within the Site or Job Portal, you do so at your own risk and subject to the terms of use for those websites.  

Indemnity 

You agree to defend, indemnify, and hold harmless ITS and any other party involved in creating, producing, or delivering the Site or Job Portal, and their respective directors, officers, employees, agents, shareholders, licensors, and representatives, from and against all claims, losses, costs, and expenses arising out of: (a) your use of or activities in connection with the Site or Job Portal (b) any violation of these Terms of Use by you or through your account, or (c) any allegation that any submission you make available or create through the Site or Job Portal infringes on or otherwise violates the copyright, trademark, trade secret, privacy, or other intellectual property or other rights of any third party. 

Geographic Restrictions 

The Site is based in Costa Rica, and although it may be accessible throughout our galaxy or beyond, not all services referred to within it are available to everyone or in all locations or jurisdictions. We reserve the right to limit the availability of this Site and/or the Job Portal to any person, geographic area, or jurisdiction at our discretion. 

Changes to the Terms of Use 

We may revise and update these Terms of Use at any time, and if we do, we’ll adjust the “Last Updated” date at the top of the page. All updates are effective as soon as we post them, and those changes will apply to all use of the Site and the Job Portal after that date, eclipsing any prior version. Your continued use of the Site and Job Portal following an update to the Terms of Use means that you accept and agree to those updates. Please note, it’s your sole responsibility to regularly check this page so you’re aware of any changes to the Terms of Use since your last visit.  

Choice of Law, Jurisdiction, and Venue 

These Terms of Use and your use of the Site are governed by the laws of Costa Rica, without regard to its choice of law provisions or your country or state of residency. The courts of general jurisdiction located in Costa Rica will have exclusive subject matter and personal jurisdiction over any disputes arising out of, relating to, or concerning these Terms of Use and/or the Site or Job Portal, or in which these Terms of Use and/or the Site or Job Portal are a material fact. You waive any jurisdictional, venue, or inconvenient forum objections to such courts. 

Severability

If any provision of these Terms of Use is found to be unlawful, void, or for any reason unenforceable, that provision will be deemed severable from these Terms of Use. This will not affect the validity and enforceability of the remaining provisions within these Terms of Use.
